Trademark guidelines

The trademarks "Symbian", "Symbian OS" and other trademarks incorporating the word "Symbian" in conjunction with other words or logos ("the Symbian Trademarks") are brands of Symbian Software Ltd and as such are valuable assets to Symbian Software Ltd. The Symbian Trademarks represent the quality and integrity of Symbian's products.

These Guidelines apply to use of the Symbian Trademarks by Symbian employees, the licensees, shareholders, technology partners, developers… everyone in the wireless community ("Third Parties"). Sections 1, 3 and 6-10 apply to any use of the Symbian Trademarks by bona fidae press agencies, analysts and journalists for non-commercial purposes.

It is important to use the Symbian Trademarks correctly. Third Parties may use non-stylised (i.e. plain text) versions of the Symbian Trademarks to refer to Symbian Software Limited and Symbian OS products and services, provided that the following guidelines are adhered to ("Using the Symbian Trademarks"); no party without a formal licensing agreement may use any graphical or stylised form of the Symbian Trademarks. Third Parties that are not licensees of Symbian are permitted to use the word marks that form part of the Symbian Trademarks solely for the purposes of marketing and promoting their products and services worldwide to the extent that those products or services are based on or incorporate products or services of Symbian, or for referring to Symbian or its goods and services.

Symbian reserves the right to unilaterally modify these Guidelines, at any time and without prior notice, as it deems necessary or appropriate. Please check this website for updates from time to time. Symbian may modify the Guidelines for a specific Third Party by written agreement, in particular limited circumstances.

Using the Symbian Trademarks

The Symbian Trademarks include, but are not limited to:

SYMBIAN, SYMBIAN OS, SYMBIAN DEVELOPER NETWORK, SYMBIAN COMPETENCE CENTER, SYMBIAN TRAINING PARTNER, SYMBIAN PLATINUM PARTNER, SYMBIAN AFFILIATE PARTNER, SYMBIAN SIGNED, EPOC, EPOC16, EPOC 32, EPOC WORLD, and all stylised (i.e. graphical logo) versions of the afore mentioned trademarks.

1. "SYMBIAN" should be used when referring to the company, Symbian Software Ltd in an abbreviated form. "SYMBIAN OS" must be used when referring to the operating system licensed by Symbian Software Ltd.

2. The Symbian Trademarks must not be used as, or incorporated into any other trade name, company or business names, website domain name (Uniform Resource Locator, URL), product or service name, trademark or logo. In particular, you must not, through use of the Symbian Trademarks, represent any of your products or services as being provided by Symbian.

3. Correct use of product versioning must be maintained throughout, either as "Symbian OS Version 9.1", with a capitalized V used in relation to the word "Version" or as "Symbian OS v9.1" with the "v" in lowercase if the word "Version" is abbreviated:

INCORRECT: "…this phone is powered by Symbian OS V9.2…"

CORRECT: "…this phone is powered by Symbian OS Version 9.2…"

4. After the first prominent occurrence of each of the Symbian Trademarks on any product, product packaging, product labels, documentation, advertisements, press releases, signage, tradeshow materials, marketing materials, collateral, web pages, letterhead, business cards or any other materials ("the Materials"), the trademark symbol (™) must be used.

5. On any Materials on which any Symbian Trademarks appear, the legend "Symbian and all Symbian based trademarks and logos are trademarks of Symbian Software Limited" must be inserted.

6. The Symbian Trademarks must not be used in the possessive form:

INCORRECT: "One of the key benefits is Symbian OS's ability to…"

CORRECT: "One of the key benefits of Symbian OS is its ability to…"

Only the company name may be used in the possessive (for example, "Symbian's employees").

7. "Symbian OS" must always be preceded and followed by a space (for example, "Symbian OS News", not "Symbian OSnews").

8. The Symbian Trademarks must not be used as verbs:

INCORRECT: "the device Symbian's the telephone software"

CORRECT: "the device operates Symbian OS" or "the device utilises Symbian OS"

9. The Symbian Trademarks must not be used in the plural form, instead make the nouns they describe plural:

INCORRECT: "…purchased many Symbian OSes…"

CORRECT: "…purchased many phones powered by Symbian OS…"

10. All Symbian Trademarks must incorporate the exact style, type specifications and capitalization as set out in the Corporate Identity Guidelines:

INCORRECT: "Symbian developer network"

INCORRECT: "Symbian os"

CORRECT: "Symbian Developer Network"

CORRECT: "Symbian OS"

11. With Symbian's prior written consent, you may use "Symbian OS" to refer to a product name, but only in the form of "XYZ for Symbian OS".:

INCORRECT: "…SDK Symbian OS v6.0 version"

INCORRECT: "…Chequers for Symbian"

CORRECT: "…SDK for Symbian OS v6.0"

CORRECT: "…Chequers for Symbian OS"

12. In the interests of fair use, you must not use any other trade names, trademarks or other designations of source which may create a likelihood of confusion with the Symbian Trademarks.

13. Any use of the Symbian Trademarks must not bring the Symbian Trademarks or Symbian into disrepute.

14. The Symbian Trademarks must not be used more prominently on Materials than your own proprietary trade marks, or product or service names.

15. You must not use any of the Symbian Trademarks in a manner likely to prejudice their legal protection or validity. In particular, without prejudice to the generality of the foregoing, you shall ensure that if any other logos and/or trade marks are used or incorporated on the Materials they are, subject to clause 11 kept separate from and are not used in any manner which could lead to confusion as to the ownership of the Symbian Trademarks.

16. Use of the Symbian Trademarks in accordance with these Guidelines whether with or without Symbian' express written consent, does not give you any legal interest in, or right to, any of the Symbian Trademarks, any name which combines a Symbian Trademark with any other trademark, trade name or company name, or any variation of the Symbian Trademarks.

17. You shall not, directly or indirectly, in any country or governing body, apply to register in your own name, or otherwise attempt to acquire any legal interests in or right in or to, any Symbian Trademark, any trademark which combines a Symbian Trademark with any other trademark, trade name or company name, or any variation of any Symbian Trademark.

18. All goodwill generated by you from the use of the Symbian Trademarks shall accrue for the benefit of Symbian.

19. Use of the Symbian Trademarks must not mislead consumers into believing that there is endorsement, affiliation or sponsorship of your company, product or service by Symbian if there is no such endorsement, affiliation or sponsorship.

20. Symbian reserves the right to take legal action against you for any use of the Symbian Trademarks in breach of these Guidelines.

21. These Guidelines shall be governed by and shall take effect in accordance with the provisions of English law and are subject to the exclusive jurisdiction of the English courts.

Logos, images and photographs

The Symbian image library contains photos, images and logos that can be used free of charge solely by bona fide press agencies, analysts and journalists publishing articles specifically about Symbian and its products and services. These photos, images and logos cannot be used for any commercial purposes and must always be used in accordance with the guidelines supplied with the files. You can find the image library here.
